Tariff preferences of the Eurasian Economic Union – requirements for issuance of a Certificate of Origin of the Goods under form A.

A Certificate of Origin of the Goods under form A is used as a certificate of origin of goods from a developing or least developed country and is submitted to the customs authorities of the goods importing country for the purpose of granting the tariff preferences within the framework of a unified system of tariff preferences.

1. Goods consigned from (exporter’s business name, address, country)

The name and address of the exporter (supplier) of the goods (the seller of the goods under the contract or other person, if it has been granted the right to supply the goods, including the producer of the goods).

2. Goods consigned to (consignee’s name, address, country)

The name and address of the person receiving the goods shall be indicated. In the event that the specific recipient of goods is not specified at the time of issuing the certificate, “to order” or the name of the state of one of the importing countries in the language in which the certificate is to be filled shall be indicated in the column.

It is also assumed that the name and address of a specific recipient of the goods will be pre-printed later after the entry “to order” or the name of the state of one of the Parties importing the goods in the language in which the certificate is filled

3. Means of transport and route (as far as known)

Information on the route of transportation of the goods and vehicles (as far as is known) is indicated.

4. For official use

Used for special marks

If a duplicate certificate is issued instead of the damaged or lost, a duplicate shall be indicated in the column 4 by the authorized body of the country of origin of the goods. In this case, the period of validity of the duplicate certificate is calculated from the date of issue of the original certificate.

In case the certificate is issued after the goods are shipped, the column is marked “issued retrospectively”.

In case of cancellation for any reason by the authorized body of the country of origin of the goods of the previously issued certificate, the entry “issued instead” is made in column 4 of the newly issued certificate with the number and date of issue of the revoked certificate.

It is assumed that the graph can be empty.

The reference (registration) number of the certificate is indicated. It is allowed to handwrite the reference (registration) certificate number. The name of the country in which the certificate is issued shall be indicated.

5. Item number

In case of declaration of information about several goods in one certificate, the serial number in the certificate shall be indicated before each commodity. It is allowed that the column is empty.

6. Marks and numbers of packages

Data on the number of packages and markings shall be indicated. If the certificate contains information about several products, the data is provided without any intervals between them, or these intervals are crossed out. The entry “no marks” is allowed.

It is allowed the column to be empty.

7. Number and kind of packages, description of goods

The commercial name of the goods, its model, brand, modification, article, other data, allowing carrying out the unambiguous identification of the goods with the goods declared for the purposes of customs clearance, as well as packaging, the type of packaging and the number of packages are indicated.

If there is not enough space for the description of the goods in the field of the column, additional sheets are used, executed on the same forms as the main sheet of the certificate, which must be certified by the signature and seal of the competent authority that issued the certificate, and have the same registration number as the main certificate sheet.

If there is a reference to the specification for the contract in this column, a copy of the latter must also be certified by the seal of the national competent authority that issued the certificate.

If the certificate contains information about several products, the descriptions of the goods are given without intervals between them or these intervals are crossed out.

8. Origin criterion (see notes overleaf)

The criterion of origin of the goods is indicated:

“P” – the goods are fully produced in the country of export;

“Y” (indicating the percentage of the cost of raw materials, semi-finished products or finished products originating in another country or of unknown origin used in the production of the goods, in the value of the exported goods determined on the basis of the manufacturer’s price ex works, for example, “Y 15%”) – the goods are processed or processed;

“Pk” – the goods are manufactured in one of the countries covered by the tariff preferential treatment of the state of the Parties and processed in other (one or several) such countries.

The criterion for the origin of the goods must be indicated for each product declared in column 7 of the certificate.

If different goods are declared in the certificate, some of which are classified in one four-digit commodity position of the Harmonized Commodity Description and Coding System, the indication of one letter designation of the criterion of origin for all goods of this four-digit commodity item is allowed in column 8.

9. Gross weight or other quantity

The weight of the goods (gross) or other data on the quantity of the goods is indicated. If several goods are declared in the certificate, the weight data (gross) or other data on the quantity of the goods are given for each separately named product.

10. Number and date of invoices

The number and date of the invoice or pro forma invoice are indicated. The column can be specified as one common invoice or pro forma invoice for all goods declared in the certificate, and, if necessary, several invoices or pro forma invoices for some separately named goods.

If at the time of issue of the certificate the data on the invoice or pro forma invoice are not known to the recipient of the certificate specified in column 1 of the certificate, it is allowed that column 10 may be empty.

11. Certification

The column contains data on the date and place of certificate authentication, the name and seal, of the body authorized to certify the origin of the goods in accordance with the legislation, as well as the signature of the official of the said authority authorized to confirm the authenticity of the certificate.

The seal must have a clear impression, which, if necessary, makes identification possible for its authenticity

12. Declaration by the exporter

The top line indicates the name of the country of origin of the goods

The information given in the certificate is signed in this column by the authorized person of the exporter (supplier) indicated in column 1

12. Declaration by the exporter

The information given in the certificate is signed in this column by the authorized person of the exporter (supplier) indicated in column 1

The presence of the seal of the exporter (supplier) in the column is not a mandatory requirement

A number of general mandatory requirements are presented to the certificate under the form “A”, in accordance with the Agreement of 12.12.2008 “On Rules for Determining the Origin of Goods from Developing and Least Developed Countries”:

The period of application of the certificate is limited to 12 months from the date of its issue

The certificate must be completed in one of two languages: in Russian or in English

The actual quantity of the delivered goods should not exceed the quantity specified in the certificate by more than 5 percent

The certificate is produced by printing on paper with a protective mesh or protective color field

The certificate must be filled in hard copy

The certificate does not allow the use of facsimile signatures of persons, the presence of any erasures and blots

In the certificate, a reference (registration) number must necessarily be affixed, and columns 1, 5 shall be filled.

The unused space in columns 5 to 10 must be crossed out in order to prevent the introduction of any additional information to them

The certificate is submitted to the customs authorities on paper in printed form.
